Lumeirah is a fashion brand operated by RIVY CREATIVE STUDIO - FZCO, a company registered in Dubai, United Arab Emirates under Trade License No. 80422.

Throughout these Terms & Conditions, the terms “Lumeirah”, “we”, “us” and “our” refer to RIVY CREATIVE STUDIO - FZCO operating the Lumeirah brand.

We operate this website and online store, including all related information, content, features, tools, products and services, to provide our customers with an online shopping experience.

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and services.

These Terms & Conditions, together with our Privacy Policy, Refund & Returns Policy, Shipping Policy and any other policies referenced on our website, govern your access to and use of the Lumeirah website, online store, products and services.

By visiting our website, creating an account, placing an order or otherwise using our services, you agree to these Terms & Conditions.

If you do not agree with these Terms & Conditions, please do not use our website or services.

Nothing in these Terms & Conditions excludes, restricts or limits any rights or remedies that cannot lawfully be excluded under the applicable laws of the United Arab Emirates.

SECTION 1 – ELIGIBILITY AND ACCOUNT

By using our website or placing an order, you confirm that you have the legal capacity to enter into a binding agreement under applicable law.

If you are not legally able to enter into a binding agreement in your jurisdiction, you may use our services only with the involvement and consent of a parent or legal guardian.

You may be required to provide certain information when using our services, including your name, email address, telephone number, billing address, delivery address and payment information.

You confirm that all information provided by you is accurate, current and complete.

If you create an account, you are responsible for maintaining the confidentiality of your login details and for activity carried out through your account.

You must notify us promptly if you believe your account has been accessed or used without your authorisation.

SECTION 2 – PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, colours, measurements, materials and other information displayed on our website are accurate.

However, the appearance of colours and products may vary slightly depending on photography, lighting conditions, screen settings and device configuration.

Minor variations in colour, texture, dimensions, stitching or finish may also occur due to the nature of fabrics and garment production.

Such minor variations do not automatically constitute a defect.

We reserve the right to correct or update product information where reasonably necessary.

All products are subject to availability.

SECTION 3 – LIMITED EDITIONS

Lumeirah may release certain products in limited quantities.

Where a product is expressly identified as a limited edition or as being limited to a specified number of pieces worldwide, availability will be limited to the quantity stated.

Once a limited-edition product is sold out, it may not be reproduced or restocked.

The limited-edition nature of a product does not limit any mandatory rights available to consumers under applicable UAE law.

SECTION 4 – ORDERS

When you place an order through our website, you are making an offer to purchase the selected products.

An automated order acknowledgement or payment confirmation does not necessarily constitute final acceptance of your order.

Your order is accepted when we confirm that it has been processed and accepted for fulfilment.

We may refuse, limit or cancel an order where reasonably necessary, including where:

the product is unavailable;
there is an obvious pricing or product information error;
payment cannot be authorised;
we reasonably suspect fraud or unauthorised use;
shipping restrictions apply;
your order violates these Terms & Conditions; or
acceptance of the order would violate applicable law or regulatory requirements.

If we cancel an order after payment has been received, the relevant amount will be refunded using the original payment method unless otherwise agreed.

Please review your order carefully before submitting it, including the selected product, size, colour, quantity, delivery address and contact details.

SECTION 5 – PERSONAL USE

Unless otherwise agreed by us in writing, Lumeirah products purchased through our website are intended for personal use.

You may not purchase products for unauthorised commercial resale or redistribution.

We reserve the right to refuse or cancel orders that we reasonably believe are intended for unauthorised resale.

SECTION 6 – PRICES

Prices are displayed in the currency indicated on our website or at checkout.

Our primary store currency may be AED, although Shopify may display converted prices depending on your location or selected currency.

Prices and promotions may change before an order is placed.

The price applicable to an order will be the price shown at checkout at the time the order is submitted.

Shipping charges, where applicable, will be displayed before checkout is completed.

For international orders, customs duties, import taxes, customs clearance fees and similar destination-country charges are not included unless expressly stated otherwise.

SECTION 7 – PAYMENT

You agree to provide accurate and complete payment information.

By submitting payment details, you confirm that you are authorised to use the selected payment method.

Payments may be processed through Shopify or other authorised third-party payment providers.

We do not directly store full payment card details where such information is handled by a third-party payment processor.

We may cancel or hold an order if payment is not successfully authorised or where additional verification is reasonably required.

SECTION 8 – PROMOTIONS AND DISCOUNTS

Lumeirah may offer promotional codes, discounts, launch offers or other promotional campaigns.

Such offers may be subject to additional conditions, including expiry dates, product exclusions, minimum spend requirements or geographic restrictions.

Unless expressly stated otherwise:

promotions cannot be combined;
promotional codes cannot be applied retrospectively to completed orders; and
promotions have no cash value.

Products purchased during a sale or promotional period may still be returned in accordance with our Refund & Returns Policy, provided they meet the applicable return conditions.

SECTION 9 – PRE-ORDERS

Certain products may be available for pre-order before they are ready for immediate dispatch.

Any production, launch, availability or dispatch date displayed for a pre-order is an estimate unless expressly confirmed as guaranteed.

Estimated dates may change due to manufacturing delays, supplier issues, logistics, customs procedures or circumstances outside our reasonable control.

If there is a significant delay affecting a pre-order, we may contact you using the contact details provided with your order.

A pre-order may be cancelled before dispatch by contacting us at info@lumeirah.ae.

Where an eligible pre-order is cancelled before dispatch, the amount paid for the cancelled product will be refunded to the original payment method.

Once a pre-order has been dispatched, our standard Refund & Returns Policy will apply.

Nothing in this section limits any mandatory rights available under applicable UAE law.

SECTION 10 – UAE SHIPPING

Estimated delivery within the United Arab Emirates is approximately:

1–3 business days after dispatch.

Delivery times are estimates and may vary due to courier delays, public holidays, weather, operational disruptions or other circumstances outside our reasonable control.

SECTION 11 – INTERNATIONAL SHIPPING

Estimated international delivery is approximately:

5–10 business days after dispatch.

International delivery times may vary depending on the destination country, courier network, customs clearance and other circumstances outside our reasonable control.

We do not guarantee delivery on a specific date unless expressly confirmed in writing.

SECTION 12 – DELIVERY INFORMATION

You are responsible for providing a complete and accurate delivery address and contact information.

If an order cannot be delivered due to incorrect or incomplete information provided by you, additional shipping costs may apply if the order is resent.

If a delivery issue occurs that is attributable to us, the courier or another party for whom we are legally responsible, your rights under applicable UAE law will remain unaffected.

Risk of loss or damage passes to you when the products are delivered to you or to a person authorised by you to receive them, except where applicable law provides otherwise.

SECTION 13 – CUSTOMS, DUTIES AND IMPORT TAXES

International orders may be subject to customs duties, import taxes, customs clearance fees or other charges imposed by the destination country.

Unless expressly stated otherwise at checkout, these charges are the responsibility of the customer.

Lumeirah does not control the amount of customs duties or taxes imposed by authorities outside the UAE.

Customers are responsible for checking applicable import requirements before placing an order.

If an order is returned to us because customs charges were not paid or customs clearance was not completed, reasonable costs actually incurred in connection with the return may be deducted from any refund where permitted by applicable law.

SECTION 14 – CHANGE-OF-MIND RETURNS

In addition to any mandatory rights available under applicable UAE law, Lumeirah offers a voluntary return policy for eligible products.

You may request a return within 14 calendar days from the date of delivery.

To qualify for a change-of-mind return, the product must be:

unworn;
unused;
unwashed;
unaltered;
undamaged;
free from perfume, makeup, deodorant, stains or other signs of wear;
returned with all original tags attached; and
returned with its original packaging where applicable.

To request a return, contact info@lumeirah.ae within 14 calendar days of delivery.

The 14-day return policy in this section is a voluntary Lumeirah policy and does not replace or restrict any mandatory consumer rights provided under UAE law.

SECTION 15 – EXCHANGES

Lumeirah does not currently offer voluntary direct exchanges for change-of-mind requests, including size or colour changes.

If you wish to purchase another size, colour or product, you may return the eligible original item for a refund and place a new order.

Availability of the replacement item cannot be guaranteed.

This policy does not restrict any statutory right to a return, replacement, exchange, refund or other remedy that may apply under UAE law where a product is defective, incomplete, damaged, incorrectly described, non-conforming or otherwise subject to a mandatory consumer remedy.

SECTION 16 – SALE AND DISCOUNTED ITEMS

Sale, promotional and discounted items may be returned under the same voluntary return conditions as full-price items unless otherwise expressly stated before purchase and permitted by applicable law.

Mandatory consumer rights remain unaffected.

SECTION 17 – DEFECTIVE, DAMAGED, INCORRECT OR NON-CONFORMING PRODUCTS

If a product received by you is defective, incomplete, damaged, incorrect or materially inconsistent with the description provided at the time of purchase, please contact us as soon as reasonably possible at info@lumeirah.ae.

Please provide:

your order number;
a description of the issue; and
photographs or other reasonable evidence where appropriate.

We will assess the matter and provide the remedy required under applicable UAE consumer protection and e-commerce laws.

Depending on the circumstances and applicable law, such remedies may include return, exchange, replacement, refund or another appropriate remedy.

Nothing in these Terms & Conditions limits or excludes any mandatory consumer right or remedy available under applicable UAE law.

SECTION 18 – RETURN SHIPPING

For voluntary change-of-mind returns, the customer is responsible for the cost of returning the product to Lumeirah.

Where the return results from a defect, damage, incorrect item or other matter for which Lumeirah is legally responsible, return costs will be handled in accordance with applicable UAE law.

Original shipping charges are not refundable for voluntary change-of-mind returns unless otherwise required by law.

We recommend using a trackable shipping method when returning products.

SECTION 19 – REFUNDS

Returned products will be inspected after receipt.

If the return is approved, the refund will be issued to the original payment method unless otherwise agreed or required by law.

The time required for the refunded amount to appear in your account may vary depending on your bank, card issuer or payment provider.

We are not responsible for delays caused solely by the banking or payment provider after the refund has been processed by us.

Any mandatory refund rights available under UAE law remain unaffected.

SECTION 20 – PRODUCT CARE

Customers are responsible for following any care instructions provided with the garment or displayed on the care label.

Damage caused by misuse, incorrect washing, improper storage, alterations, accidental damage or failure to follow care instructions may not constitute a manufacturing defect.

This section does not affect any mandatory consumer rights relating to genuine defects or non-conforming products.

SECTION 21 – INTELLECTUAL PROPERTY

All content available through the Lumeirah website and services, including the Lumeirah name, logos, trademarks, designs, product names, collection names, photographs, videos, graphics, illustrations, text, packaging concepts, visual identity, website content and other original material, is owned by or licensed to RIVY CREATIVE STUDIO - FZCO.

Such content is protected by applicable intellectual property laws of the United Arab Emirates and, where relevant, applicable international laws and treaties.

The website and its content are provided for personal, non-commercial use only.

You may not reproduce, copy, modify, distribute, publish, sell, licence, commercially exploit or create derivative works from our protected content without our prior written consent.

Nothing in these Terms & Conditions transfers ownership of any intellectual property to you.

SECTION 22 – THIRD-PARTY SERVICES

Our website may use third-party services, including payment processors, courier providers, analytics providers, marketing platforms and technology services.

Your use of certain third-party services may be subject to their own terms and privacy policies.

To the extent permitted by applicable law, we are not responsible for acts or omissions of independent third-party providers that are outside our reasonable control.

We do not control those third-party websites and are not responsible for their content, availability, security, privacy practices or terms.

You access third-party websites at your own discretion.

SECTION 24 – SHOPIFY

The Lumeirah online store is powered by Shopify.

Shopify provides the technology and infrastructure used to operate our online store.

Your purchase of Lumeirah products is made directly from RIVY CREATIVE STUDIO - FZCO operating as Lumeirah.

Shopify is not the seller, manufacturer or supplier of Lumeirah products.

Nothing in this section limits any legal rights you may have against Shopify in relation to services provided directly by Shopify to you.

SECTION 25 – PRIVACY AND PERSONAL DATA

Personal information collected through our website is processed in accordance with our Privacy Policy and applicable UAE data protection laws.

Because our store is hosted by Shopify and uses third-party services, personal information may be processed by service providers involved in website hosting, payment processing, order fulfilment, delivery, analytics, customer support and marketing.

Where personal data is transferred internationally, such processing will be handled in accordance with applicable legal requirements.

SECTION 33 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Lumeirah and RIVY CREATIVE STUDIO - FZCO will not be liable for indirect, incidental or consequential losses that were not reasonably foreseeable and that arise solely from use of our website or services.

Nothing in these Terms & Conditions excludes or limits liability where exclusion or limitation is prohibited by applicable law.

Nothing in these Terms & Conditions limits:

mandatory consumer rights;
liability for fraud or fraudulent misrepresentation;
liability for intentional misconduct; or
any other liability that cannot lawfully be excluded under UAE law.

SECTION 34 – INDEMNITY

To the extent permitted by applicable law, you agree to compensate RIVY CREATIVE STUDIO - FZCO for losses, claims or reasonable costs arising directly from:

your material breach of these Terms & Conditions;
unlawful or fraudulent use of our website;
infringement by you of third-party intellectual property rights; or
unauthorised use of another person’s account or payment information.

This section does not apply to losses caused by our own unlawful conduct, negligence or breach.

SECTION 35 – SUSPENSION AND TERMINATION

We may suspend or terminate access to an account where reasonably necessary, including where:

these Terms & Conditions have been materially breached;
fraudulent or unlawful activity is suspected;
website security is at risk; or
suspension or termination is required by law or a competent authority.

Termination will not affect rights or obligations that arose before termination.

If any provision of these Terms & Conditions is found by a competent court or authority to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.

Failure by us to immediately enforce any right under these Terms & Conditions does not constitute a waiver of that right.

SECTION 38 – ENTIRE AGREEMENT

These Terms & Conditions, together with our Privacy Policy, Refund & Returns Policy, Shipping Policy and any applicable product or promotion-specific terms, constitute the agreement governing your use of our online store and your purchases from Lumeirah.

No provision of these Terms & Conditions will override any mandatory rights granted to consumers under applicable law.

SECTION 39 – ASSIGNMENT

You may not transfer your contractual rights or obligations to another person without our prior written consent.

We may transfer our rights and obligations as part of a lawful restructuring, business transfer, merger or similar transaction, subject to applicable law.

SECTION 40 – GOVERNING LAW AND JURISDICTION

These Terms & Conditions and purchases made through the Lumeirah website are governed by the applicable federal laws of the United Arab Emirates and, where applicable, the laws and regulations in force in the Emirate of Dubai.

Subject to mandatory consumer protection rights and any jurisdiction required by applicable law, disputes arising out of or relating to these Terms & Conditions or purchases from Lumeirah shall fall within the jurisdiction of the competent courts of Dubai, United Arab Emirates.

Nothing in this section limits any mandatory consumer right relating to dispute resolution or jurisdiction under applicable law.

SECTION 41 – CHANGES TO THESE TERMS

We may update these Terms & Conditions to reflect changes to our business, services, website, policies or applicable law.

The latest version will be published on this page together with the date of the most recent update.

Where required by applicable law, material changes will be communicated appropriately.

Changes will not retrospectively remove rights already acquired in connection with completed transactions.
